I didn't want it in there if it was going to be altered and not include my watermark...

I got in contact with the calender creator, we have reached an agreement.

This is really good idea of reporting.Generally,people abandon the stolen photos without report.But once we abandoned it,we may forget later.If the photos are good enough for everything,We needn't skip this issue.So,Nonlegal issues cannot be tolerated.

Someone is telling me that because it's for editorial use that it's fine but I'm pretty sure it's still a copyright breach as I wasn't contacted. Plus there's a link to the shop on the same page.

Now, I'm going to be releasing my new website shortly and will use this to get some more coverage on the site but I'm curious at to what the law with with using photo's on blog websites?

People are not allowed to repost your images without your consent, bottom line. Juan Perez is the owner/creator of that site and I have had problems with him before. Total asshat.

Welp, over a year later since I contacted the tire company that used my pics in magazine advertisements, we concluded with a hefty little settlement smile.gif Barely touched the 5 figure range but back down to 4 after lawyer fees lol. Either way, free money for me since that shoot was 3-4 years old by now and I no longer had any intention to do anything else with those photos. Goes to show that some cases are sometimes worth fighting for. This is after I had 3 local lawyers tell me to just chalk it up as a lesson learned and not do anything about it.

Hi all. On my quest to find more information on dealing with a stolen image of mine, I stumbled across this site.
I have gone through and read all 12 pages in this thread and there's lots of good info here, so thank you all for that.

My dilemma is that a shop owner has used one of my images without my knowledge or permission to print out his business cards.
Correct me if I'm wrong but according to Canadian law, this is an infringement of copyright because it is used for commercial reasons.

A question I have is how do I appraise an accurate quote for the invoice if I don't know how many cards he has printed out already?
I have used this price calculator and came up with this based on a reasonable estimation:

Type of Use:: Advertising
Specific Use:: Free standing insert
Press Run:: 10,000 or less
Size:: 1/4 Page or Spot use
Low Price:: $200.00
Average Price:: $350.00
High Price:: $500.00

Also, should he choose not to pay, what other viable options do I have besides hiring a lawyer?

How did that company get ahold of your image in the first place? Do you have any contact with the shop owner? It may be more beneficial to work out a deal directly with the shop owner, as it may lead to more shoots in the future.

I do not know where he obtained my image. He could have gotten a print screen from my flickr as I have restricted downloading of my images simply to reduce situations I'm currently in.
I have his contact and am in the process of writing up an e-mail addressing this dilemma and proposing a solution in which we can both agree upon. However, I would still like to prepare for disagreements.
One of these solutions is that I offer to redesign his current card that flows better with the photo, for a discounted fee.

Anyone know if these guys selling wheels of Ebay are real companies or just a one-man-show-thing? Or, do Ebay make you say something about the copyright of the pictures you upload there? This guy has several of my images all over his ebay-shop. You guys might want to check if he has any of yours as well... Donīt really know if there is any use of doing something about it though...

compile list of all members with photos, write email to app developer stating if the photos are not removed we will have a bill sent to them via an attorney for a percentage of the profits of the apps.
